By downloading, installing, or playing Road Rascals (the "Game"), you agree to these Terms of Service and End User License Agreement (together, the "Terms") with Edward Luis Requilman ("we", "us"). If you do not agree, do not use the Game. If you are under the age of majority where you live, you may use the Game only with the consent of a parent or legal guardian, who agrees to these Terms on your behalf.
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to install and play the Game on devices you own or control, for personal, non-commercial entertainment. You may not: copy, modify, reverse engineer, decompile, or create derivative works of the Game (except where the law permits); rent, sell, sublicense, or distribute it; use cheats, bots, automation, or exploits; or interfere with the Game's operation or other players' experience. We reserve all rights not expressly granted.
The Game includes virtual currency (coins and gems) and virtual items (vehicles, upgrades, cosmetics). These:
Any "free" currency (e.g. from rewarded ads or gifts) is promotional and may be changed or withdrawn at any time.
Real-money purchases are processed by Apple App Store or Google Play, subject to their terms and payment policies - we do not receive your payment card details. Purchases of consumable items are final; refunds are handled by Apple/Google under their policies, not by us, except where the law requires otherwise. Prices may change. You are responsible for any taxes.
The Game may show optional, rewarded advertisements (you choose to watch them for a reward). Ads are delivered by third-party partners (see the Privacy Policy) who may process device/ad identifiers. We are not responsible for third-party ad content. There are no forced/interstitial ads.
The Game and its original content, features, artwork, audio, and code are owned by us or our licensors and are
protected by intellectual-property laws. Third-party assets are used under their own licenses (see
THIRD_PARTY_NOTICES.md). "Road Rascals" and related marks are ours. You get no rights to our IP except the
limited license in Section 2.
If the Game lets you submit anything (e.g. a display name for leaderboards), you must not submit content that is unlawful, offensive, infringing, or that impersonates others. We may remove content and restrict accounts that violate these Terms or distort leaderboards through cheating.
THE GAME IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE GAME WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. Some jurisdictions do not allow the exclusion of implied warranties, so some of the above may not apply to you.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR VIRTUAL ITEMS, ARISING FROM YOUR USE OF THE GAME. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) USD 10.00. Some jurisdictions do not allow these limitations, so they may not fully apply to you.
You agree to indemnify and hold us harmless from claims arising out of your misuse of the Game or violation of these Terms, to the extent permitted by law.
We may suspend or terminate your access to the Game at any time for violation of these Terms or to comply with the law. You may stop using the Game at any time by uninstalling it. Sections that by their nature should survive (e.g. 3, 6, 8, 9, 10, 12) survive termination.
These Terms are governed by the laws of Alberta, Canada, without regard to conflict-of-laws rules. [OPTIONAL, review with a lawyer: any dispute will be resolved by binding individual arbitration in the courts of Alberta, Canada, and you and we waive class actions - note this clause is regulated and unenforceable in some regions.] Nothing here limits any non-waivable statutory rights you have as a consumer.
The Game is a general-audience ("Everyone") game and is not directed to children under 13. We do not knowingly collect personal information from children under that age in violation of applicable law. A parent/guardian who believes a child has provided personal information may contact us to have it removed.
We may update these Terms; material changes will be posted at this URL with a new effective date. Continued use after changes means you accept the updated Terms.

If you do not supply your own EULA in App Store Connect, Apple's standard Licensed Application End User License Agreement applies. If you DO use these Terms as your custom EULA, Apple requires that, at minimum, they state: the license is between YOU and the developer only, NOT Apple; Apple has no obligation to provide support or maintenance for the Game; Apple is not responsible for product warranties or third-party claims (IP, consumer protection); and Apple and its subsidiaries are third-party beneficiaries of these Terms with the right to enforce them. Those points are hereby incorporated. See Apple's "Schedule to the Developer Program License Agreement" for the current required minimum terms.
Your use of the Game via Google Play is also subject to the Google Play Terms of Service. Purchases are subject to the Google Play refund policy.
